After watching Bill
Belichick decide to go for it on 4
th down last night and subsequently loosing to the Colts I thought I had witnessed the dumbest decision that a human could make in quite a while. However, his decision really harmed no one. I am afraid that the decision to send Khalid
Sheikh Mohammed to NYC to stand trial may.
This decision is so insane it borders on reckless. I suppose the only up side that may possibly come of this is that after hearing testimony from the killer himself how he planned and executed the murderous attack on 9/11 the few folks who still claim that this was a conspiracy hatched by the American government or the Jews will now have to argue with
KSM.
I have no problem with
KSM being tried before we hang him-of course that is if he is found guilty. I have no fear of him not being convicted. I do fear that this trial of
KSM and four other co-conspirators in NYC is a security risk not only to the people of NYC but may also turn into an event that does nothing other than give this animal and his cause a lot of press-which by the way is EXACTLY what he wants.
He needs to be tried by the military. Being tried by the military is not as fair as a Federal trial. However, a military tribunal is the only proper place that an enemy combatant should be tried. There are many reasons for that. Not the least of which is the protection of key witnesses and intelligence gathering techniques.
KSM gave up any right he had to being treated like a "normal" criminal when he decided to take up arms against the United States.
I would also say that because he is being tried in Federal court he MUST be afforded the exact same rights that any person in the justice system is afforded. If we don't treat him EXACTLY the same we are making our own justice system look like a kangaroo court. I am the first to admit that I don't like the idea of military tribunals. The
UCMJ (Uniform Code of Military Justice) is a blunt instrument. But, only people who meet certain qualifications can be tried in this system-ya know like the types of people that attack two skyscrapers as well as the Pentagon and if the folks on United 93 didn't act heroically there would have been another building destroyed as well. It is for those reasons that my heart isn't broken about seeing
KSM being tried by the military. For God's sake this guy is as much of an enemy of the state as can possibly exist.
It must be noted too that by treating
KSM "justly" will not cause the US to be thought of as any different by our enemies. They already hate us. They hate you
whether you read the
Huffington Post or are a Republican lap dog-they could care less. They hate us
because we are Americans and no reasoning with them will ever change that fact.
I also think drawing a pool of civilian residents of NYC may actually place some of their lives in danger. This is a serious decision with
many possible implications. It looks like the decision has been made but it is a poor one.
